Inchly Terms of Use
Effective date: October 21, 2026
Company: Montgomery Appworks LLC, Oklahoma, USA ("we", "us")
Contact: justin@montgomeryappworks.com · support@montgomeryappworks.com
These Terms of Use ("Terms") are an agreement between you and Montgomery Appworks LLC. They cover your use of the Inchly apps for iOS, Android, and the web (the "App"). By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the App.
1. What Inchly is (and isn't)
Inchly is a personal organization and focus tool. It helps you break tasks into small steps, run focus timers, set reminders, build routines, and note your mood and energy.
Inchly is not medical advice and not a medical device. It does not diagnose or treat ADHD or any other condition, and it doesn't prevent or monitor any condition either. It is not a substitute for care from a qualified health professional. Content in the App, including pattern insights and educational cards, is for general information and personal reflection only. Always talk with a qualified health professional about your health, and before you start, stop, or change any medication or care plan.
Inchly is not an emergency or crisis service. If you are thinking about harming yourself or you're in crisis, call or text 988 (the 988 Suicide & Crisis Lifeline in the US) or visit 988lifeline.org. If you or someone else is in immediate danger, call 911 or your local emergency number.
2. Who can use Inchly
You must be at least 17 years old to use the App. By using it, you confirm that you meet this requirement and can enter into these Terms.
3. Your license to use the App
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial use on devices you own or control. If you got the App from the Apple App Store or Google Play, you must also follow that store's usage rules.
You agree not to:
- copy, modify, reverse engineer, or resell the App, except where the law expressly permits it;
- use the App, including AI task breakdown, to break the law, harm others, or create harmful, abusive, or illegal content;
- try to overload, probe, or get around the security, rate limits, or paywall of the App or our servers;
- use automated means (bots or scripts) to access our AI service.
4. Your content
Tasks, notes, routines, and check-ins you create ("Your Content") belong to you. Most of Your Content is stored only on your device. We don't have a copy, and we can't recover it if it's lost (for example, if you delete the App, lose your device, or clear your browser data). You're responsible for keeping any copies you want, for example using Settings > Export.
When you use AI task breakdown, you give us a limited permission to send the text you typed to our servers and our AI provider, OpenAI. That text is used only to generate your steps, as described in the Privacy Policy.
5. AI-generated suggestions
AI task breakdown and time estimates are automatically generated suggestions. They may be incomplete, inaccurate, or not right for your situation. You decide which steps to use, and you can edit, reorder, or delete any of them. Don't rely on AI suggestions for medical, legal, financial, safety, or other professional decisions. The AI is designed to give only general task steps, not professional advice.
6. Free features and Inchly Plus
The core features of Inchly are free: the capture → break it down → start tiny → focus → celebrate loop, distraction capture, basic reminders, a limited number of routines, mood/energy check-ins, and a limited number of AI breakdowns.
Inchly Plus is an optional upgrade that unlocks unlimited AI breakdowns, unlimited routines and templates, pattern insights, and extra mascot looks. Features may change over time. We'll describe what's included on the purchase screen.
Plus is available as:
- Inchly Plus Monthly: $5.99 per month, auto-renewing
- Inchly Plus Yearly: $39.99 per year, auto-renewing, with a 7-day free trial for eligible new subscribers
- Inchly Plus Lifetime: $89.99, a one-time purchase that does not renew
Prices are in US dollars. They may differ in other countries and may include tax where required. The price you'll pay is always shown in the store's purchase sheet before you confirm.
7. Subscriptions, auto-renewal, and free trials
- Payment. Purchases are made through your Apple ID (App Store) or Google account (Google Play). Payment is charged to that account when you confirm the purchase or, for a free trial, when the trial ends.
- Auto-renewal. Monthly and yearly subscriptions renew automatically at the same price and for the same period, unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the current period ends.
- Free trial. If a free trial is offered and you're eligible, you won't be charged during the trial. Unless you cancel at least 24 hours before the trial ends, it converts to a paid subscription and you'll be charged the subscription price. If you buy a subscription during a trial, any unused part of the trial may be forfeited, as the store's rules allow. Eligibility for trials is determined by Apple or Google.
- How to cancel.
- iPhone/iPad: Settings > [your name] > Subscriptions > Inchly, or in the App Store app.
- Android: Google Play > Profile > Payments & subscriptions > Subscriptions > Inchly.
- Deleting the App does not cancel your subscription.
- After you cancel, you keep Plus until the end of the period you've already paid for, then the App returns to the free features. Your on-device data stays.
- Price changes. If a subscription price changes, Apple or Google will notify you as their rules require. Where required, you'll be asked to agree to the new price before it applies.
- Refunds. Purchases are processed by Apple or Google, and their refund policies apply. We can't issue refunds directly. Request one at reportaproblem.apple.com (Apple) or through Google Play's refund process (Google). Nothing in these Terms limits any refund rights you have by law.
- Restore purchases. If you reinstall the App or switch devices on the same store account, tap Restore purchases on the Plus screen or in Settings.
- Web version. Plus is purchased in the iOS or Android app. If the web version later offers Plus purchases, the terms shown at checkout will also apply.
8. Changes and availability
We may update, change, or discontinue features of the App. We'll try to give reasonable notice of changes that significantly reduce what paid Plus features include. If we stop offering the App entirely, we'll try to give advance notice, and we may provide a way for you to export Your Content. Some features need an internet connection (for example AI breakdown and purchases), and they may sometimes be unavailable.
9. Our intellectual property
The App, including its design, code, text, mascot (including "Pip"), and graphics, is owned by Montgomery Appworks LLC or its licensors and is protected by law. "Inchly" and related logos are our trademarks. These Terms don't give you any rights to them except the license in Section 3.
10. Feedback
If you send us ideas or feedback, we may use them without any obligation to you.
11. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We don't promise that the App will be error-free or uninterrupted, or that reminders will always be delivered on time. Delivery depends on your device, its settings, battery optimization, Focus/Do Not Disturb, and browser limits. Don't rely on Inchly alone for anything time-critical, such as medication, safety, or legal deadlines. We don't promise any particular outcome from using the App.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MONTGOMERY APPWORKS LLC AND ITS MEMBERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $50. Some places don't allow certain limitations, so some of these may not apply to you.
13. Indemnity
To the extent permitted by law, you agree to indemnify us against claims that arise from your misuse of the App or your violation of these Terms.
14. Ending these Terms
You can stop using the App at any time by deleting it (remember to cancel any subscription separately). We may suspend or end your access if you seriously or repeatedly break these Terms. Sections 4, 5, and 9–17 continue to apply after these Terms end.
15. Governing law and disputes
These Terms are governed by the laws of the State of Oklahoma, USA, without regard to its conflict-of-law rules. Any dispute that can't be resolved informally will be handled only in the state or federal courts located in Oklahoma, and you and we consent to their jurisdiction. Before filing a claim, please email us first so we can try to resolve it. Nothing in this section removes consumer protections you have under the laws where you live.
16. Apple App Store terms
If you downloaded the App from the Apple App Store, you also agree that:
- These Terms are between you and Montgomery Appworks LLC only, not Apple Inc. ("Apple"). We, not Apple, are solely responsible for the App and its content.
- Your license is limited to use on Apple-branded products you own or control, as permitted by the App Store's Usage Rules. Family Sharing may let others in your family group use the App as those rules allow.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the extent permitted by law, Apple has no other warranty obligation for the App.
- We, not Apple, are responsible for addressing any claims by you or third parties relating to the App. That includes product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
- If a third party claims that the App infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling, and resolving that claim.
- You represent that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms when using the App.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right to enforce them against you.
17. Google Play terms
If you downloaded the App from Google Play, your use is also subject to the Google Play Terms of Service. Google is not responsible for the App or for supporting it.
18. General
These Terms and the Privacy Policy are the entire agreement between you and us about the App. If any part is found unenforceable, the rest stays in effect. If we don't enforce a provision right away, we haven't waived it. You may not transfer these Terms. We may transfer them in connection with a merger, acquisition, or sale of assets. We may update these Terms by posting a new version with a new effective date. If a change is material, we'll tell you in the App, and continuing to use the App after it takes effect means you accept it.
